Child custody and visitation
When two spouses divorce each other the main issue that is left with is the custody of the child. The same family court that decides the divorce case also decides who will get the custody of the child. Whoever gets the custody of the child he/she will have to look after the daily affairs and upbringing of the minor child. The spouse who doesn’t get the custody of the child gets the visitation rights.

Traditionally in India custody of the child is mostly given to the mother of the child as she is the prime caretaker. This belief makes the child custody fights for fathers very difficult. In a landmark case Y. Sulochana Rani v Union of India, 2019 the supreme court held that family court should ensure that visitation rights are fixed in such a manner that the child gets to know and love his father. A child has a right to the affection of both his parents and the family court shall ensure that visitation rights are granted in such a manner.
