Dowry related crimes
There are various legislations in India that provide protection to the women in dowry related matters such as Indian penal Code and Dowry Prohibition Act. To prove dowry wife has to prove that there was some kind of cruelty or harassment, and the act was committed by her husband or her in-laws (Section 498-A).

The procedure to be followed for filing a dowry related case is-
- the wife can approach Crime against Women Cell of the area where she resides and then she has to file a written complaint against her husband or his family for cruelty. They will enter the complaint in their register.
- then they send a notice to the husband and his family summoning them to their office.
- then they will try to resolve the matter there. If the matter is resolved there only then the wife and husband and his family have to sign a settlement.
- if the concerned parties does not arrive at any settlement then Crime against women cell will forward the complaint to the concerned police station.
The women can also approach the police station directly and lodge an FIR against her husband and in-laws. If the police deny to register the FIR made by wife or CAW cell then the wife can approach the court and then court will order the police to conduct an investigation.
However, it is always preferred to file the complaint after consulting your legal adviser as he can understand the complexities of the case. If you file an FIR without consulting your legal adviser there will be something in the FIR that can be used against you in the future.
We here at Chaklan and Associates provide assistance in fighting your legal battle against dowry and upholding your rights.
